1.Загальні положення

1.1.Ця Політика конфіденційності описує, які персональні дані збирає, зберігає, використовує та розкриває ФОП Кісільчук Віталій Ігорович (РНОКПП: 3774209515, далі — «Kisilchuk», «ми») у зв'язку з роботою веб-сайту kisilchuk.com та обробкою замовлень, отриманих через сайт і месенджери (Telegram, Instagram тощо).
1.2.Ця Політика розроблена відповідно до вимог Закону України «Про захист персональних даних» (№ 2297-VI від 01.06.2010) та є невід'ємною частиною Умов надання послуг Kisilchuk.
1.3.Використовуючи Сайт або надсилаючи нам замовлення через будь-який канал, ви підтверджуєте, що ознайомилися з цією Політикою та надаєте згоду на обробку ваших персональних даних у порядку та на умовах, визначених нижче.

3.1.При оформленні замовлення та в процесі надання послуг ми збираємо такі категорії персональних даних:

Увага: мірки тіла та фотографії є чутливими персональними даними. Ми збираємо їх виключно зметою виготовлення замовленого виробу та не використовуємо в жодних інших цілях.

3.1.3.Технічні дані (збираються автоматично):

Технічні дані збираються для забезпечення коректної роботи Сайту та не використовуються для ідентифікації особи.

3.2.Дані, що надаються через месенджери. Якщо ви оформлюєте замовлення або спілкуєтеся з нами через Telegram, Instagram або інші месенджери, відповідна інформація (ваш профіль, повідомлення, вкладення) також може містити персональні дані. Зверніть увагу, що обробка даних у межах самих платформ регулюється їхніми власними політиками конфіденційності (Meta, Telegram тощо).

4.Мета та підстава обробки персональних даних

4.1.Ми обробляємо ваші персональні дані виключно з таких підстав та з такою метою:
4.1.1.виконання договору (обробка та виконання замовлення, зв'язок щодо деталей замовлення, доставка або передача готового виробу);
4.1.2.виконання вимог законодавства (зберігання документів відповідно до вимог податкового та цивільного законодавства);
4.1.3.захист законних інтересів (вирішення спорів, захист від претензій);
4.1.4.за вашою згодою — надсилання інформації про нові роботи, акції або новини бренду Kisilchuk (лише якщо ви окремо надали таку згоду).

5.Передача персональних даних третім особам

5.1.Ми не продаємо, не передаємо та не розкриваємо ваші персональні дані третім особам, крім таких випадків:
5.1.1.Служби доставки. Для доставки готового виробу ми передаємо ім'я, номер телефону та адресу доставки обраній службі доставки (Нова Пошта, Укрпошта або інша — за домовленістю). Передається лише мінімально необхідний обсяг даних.
5.1.2.Майстри та субпідрядники. У разі залучення стороннього майстра для виконання окремих етапів замовлення (наприклад, оздоблення) йому можуть бути передані мірки, фото надані клієнтом через цей вебсайт, технічні параметри виробу — без вашого імені та контактних даних, якщо це можливо.
5.1.3.Вимоги законодавства. Ми можемо розкривати персональні дані на вимогу суду, органів державної влади або у зв'язку з виконанням вимог законодавства України.
5.1.4.Instagram та Meta. Сайт може містити інтеграції з Instagram. Якщо ви взаємодієте з такими елементами або переходите до нашого акаунту в Instagram, до обробки ваших даних також застосовується Політика конфіденційності Meta Platforms Ireland Limited. Ми не контролюємо та не несемо відповідальності за обробку даних платформою Meta.

6.Файли cookie та технічні засоби відстеження

6.1.Наш Сайт може використовувати файли cookie — невеликі текстові файли, що зберігаються на вашому пристрої. Ми використовуємо cookie для:
6.1.1.забезпечення коректної роботи Сайту (технічні cookie);
6.1.2.запам'ятовування ваших налаштувань та параметрів перегляду.
6.2.Ми не використовуємо рекламні або аналітичні cookie від сторонніх платформ (як-от Google Analytics або Meta Pixel). Якщо це зміниться — ця Політика буде оновлена, і ми отримаємо вашу згоду у встановленому порядку.
6.3.Ви можете вимкнути файли cookie у налаштуваннях свого браузера, однак це може вплинути на функціональність Сайту.

7.Строки зберігання персональних даних

7.1.Ми зберігаємо ваші персональні дані протягом строків, необхідних для досягнення мети їх обробки:
7.1.1.дані замовлення (ім'я, контакти, мірки, фото) — протягом строку виконання замовлення та 3 років після його завершення (для можливого повторного замовлення та вирішення спорів);
7.1.2.фінансові документи та дані, пов'язані з оплатою, — відповідно до вимог податкового законодавства України;
7.1.3.фотографії клієнта — видаляються після завершення виробництва замовлення, якщо клієнт не надав окремої згоди на їх зберігання для портфоліо.
7.2.Після закінчення строку зберігання персональні дані видаляються або знеособлюються.

8.Ваші права як суб'єкта персональних даних

8.1.Відповідно до ст. 8 Закону України «Про захист персональних даних», ви маєте право:
8.1.1.знати про джерела збирання, місцезнаходження ваших персональних даних та мету їх обробки;
8.1.2.отримати доступ до своїх персональних даних, які ми зберігаємо;
8.1.3.вимагати виправлення неточних або застарілих даних;
8.1.4.вимагати видалення ваших персональних даних (якщо відсутні законні підстави для їх подальшого зберігання);
8.1.5.відкликати згоду на обробку персональних даних у будь-який час (не впливає на законність обробки до відкликання);
8.1.6.подати скаргу до Уповноваженого Верховної Ради України з прав людини як наглядового органу у сфері захисту персональних даних.
8.2.Для реалізації будь-якого з цих прав зверніться до нас у спосіб, зазначений у розділі 12 цієї Політики.

9.Захист персональних даних

9.1.Ми вживаємо розумних організаційних та технічних заходів для захисту ваших персональних даних від несанкціонованого доступу, втрати, знищення або розголошення. Зокрема:
9.1.1.доступ до даних клієнтів має лише обмежене коло осіб, безпосередньо залучених до виконання замовлення;
9.1.2.дані передаються через захищені канали зв'язку (HTTPS);
9.1.3.фотографії та мірки клієнтів не публікуються та не передаються без окремої письмової згоди.
9.2.Разом з тим жоден метод передачі даних через інтернет або метод зберігання не є абсолютно захищеним. У разі виявлення порушення безпеки, що може завдати шкоди вашим правам, ми повідомимо вас у найкоротші можливі строки.

10.Використання фотографій у портфоліо

10.1.Ми можемо публікувати фотографії готових виробів у нашому портфоліо (Сайт, Instagram тощо). При цьому:
10.1.1.фотографії, на яких клієнт є впізнаваним, публікуються виключно за його письмовою (у т.ч. електронною) згодою;
10.1.2.фотографії виробу без впізнаваних рис клієнта (деталі крою, тканина, оздоблення) можуть використовуватись без окремої згоди;
10.1.3.ви можете в будь-який момент відкликати згоду на публікацію — ми видалимо відповідні матеріали у розумні строки.

11.Зміни до цієї Політики

11.1.Ми залишаємо за собою право вносити зміни до цієї Політики конфіденційності. Нова редакція публікується на Сайті із зазначенням дати оновлення. Якщо зміни є суттєвими і стосуються розширення мети обробки або нових категорій даних — ми повідомимо вас про це окремо та, за необхідності, отримаємо нову згоду.
11.2.Подальше використання Сайту або надсилання замовлень після публікації змін означає вашу згоду з оновленою Політикою.

Privacy Policy

1.General provisions

1.1.This Privacy Policy describes what personal data is collected, stored, used and disclosed by Individual Entrepreneur Vitalii Kisilchuk (Tax No. 3774209515, hereinafter — “Kisilchuk”, “we”) in connection with the operation of the kisilchuk.com website and the processing of orders received through the website and messengers (Telegram, Instagram, etc.).
1.2.This Policy has been developed in accordance with the requirements of the Law of Ukraine “On Personal Data Protection” No. 2297-VI of 01 June 2010 and forms an integral part of the Kisilchuk Terms of Service.
1.3.By using the Website or sending us an order through any channel, you confirm that you have read this Policy and give your consent to the processing of your personal data in the manner and on the terms set out below.

3.1.When placing an order and in the course of providing services, we collect the following categories of personal data:

Please note: body measurements and photographs are sensitive personal data. We collect them exclusively for the purpose of making the ordered garment and do not use them for any other purposes.

3.1.3.Technical data (collected automatically):

Technical data is collected to ensure the proper operation of the Website and is not used to identify an individual.

3.2.Data provided via messengers. If you place an order or communicate with us via Telegram, Instagram or other messengers, the relevant information (your profile, messages, attachments) may also contain personal data. Please note that the processing of data within the platforms themselves is governed by their own privacy policies (Meta, Telegram, etc.).

4.Purpose and legal basis for processing personal data

4.1.We process your personal data exclusively on the following grounds and for the following purposes:
4.1.1.performance of the contract (processing and fulfilment of the order, communication regarding the details of the order, delivery or handover of the finished garment);
4.1.2.compliance with legal requirements (retention of documents in accordance with the requirements of tax and civil legislation);
4.1.3.protection of legitimate interests (resolution of disputes, defence against claims);
4.1.4.with your consent — sending information about new work, promotions or news of the Kisilchuk brand (only if you have separately given such consent).

5.Transfer of personal data to third parties

5.1.We do not sell, transfer or disclose your personal data to third parties, except in the following cases:
5.1.1.Delivery services. To deliver the finished garment, we transfer the name, telephone number and delivery address to the selected delivery service (Nova Poshta, Ukrposhta or another — as agreed). Only the minimum necessary amount of data is transferred.
5.1.2.Tailors and subcontractors. Where a third-party tailor is engaged to perform particular stages of the order (for example, finishing), they may be provided with the measurements, the photographs provided by the client through this website, and the technical parameters of the garment — without your name and contact details, where this is possible.
5.1.3.Legal requirements. We may disclose personal data at the request of a court or state authorities, or in connection with compliance with the legislation of Ukraine.
5.1.4.Instagram and Meta. The Website may contain Instagram integrations. If you interact with such elements or navigate to our Instagram account, the Privacy Policy of Meta Platforms Ireland Limited also applies to the processing of your data. We do not control and are not responsible for the processing of data by the Meta platform.

6.Cookies and technical tracking tools

6.1.Our Website may use cookies — small text files stored on your device. We use cookies to:
6.1.1.ensure the proper operation of the Website (technical cookies);
6.1.2.remember your settings and viewing preferences.
6.2.We do not use advertising or analytics cookies from third-party platforms (such as Google Analytics or Meta Pixel). Should this change — this Policy will be updated and we will obtain your consent in the established manner.
6.3.You may disable cookies in your browser settings; however, this may affect the functionality of the Website.

7.Retention periods of personal data

7.1.We retain your personal data for the periods necessary to achieve the purpose of its processing:
7.1.1.order data (name, contact details, measurements, photographs) — for the period of fulfilment of the order and 3 years after its completion (for a possible repeat order and for the resolution of disputes);
7.1.2.financial documents and data related to payment — in accordance with the requirements of the tax legislation of Ukraine;
7.1.3.photographs of the client — deleted after the completion of production of the order, unless the client has given separate consent to their retention for the portfolio.
7.2.Upon expiry of the retention period, personal data is deleted or anonymised.

8.Your rights as a data subject

8.1.Under Article 8 of the Law of Ukraine “On Personal Data Protection”, you have the right:
8.1.1.to know the sources of collection and the location of your personal data and the purpose of its processing;
8.1.2.to obtain access to your personal data which we store;
8.1.3.to demand the rectification of inaccurate or outdated data;
8.1.4.to demand the erasure of your personal data (where there are no lawful grounds for its further retention);
8.1.5.to withdraw your consent to the processing of personal data at any time (this does not affect the lawfulness of processing prior to withdrawal);
8.1.6.to lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights as the supervisory authority in the field of personal data protection.
8.2.To exercise any of these rights, please contact us in the manner set out in Section 12 of this Policy.

9.Protection of personal data

9.1.We take reasonable organisational and technical measures to protect your personal data against unauthorised access, loss, destruction or disclosure. In particular:
9.1.1.access to client data is held only by a limited number of persons directly involved in fulfilling the order;
9.1.2.data is transmitted via secure communication channels (HTTPS);
9.1.3.clients’ photographs and measurements are not published or transferred without separate written consent.
9.2.At the same time, no method of transmitting data over the internet or method of storage is absolutely secure. Should a security breach be identified that may harm your rights, we will notify you as soon as reasonably possible.

10.Use of photographs in the portfolio

10.1.We may publish photographs of finished garments in our portfolio (Website, Instagram, etc.). In doing so:
10.1.1.photographs in which the client is identifiable are published exclusively with their written (including electronic) consent;
10.1.2.photographs of the garment without identifiable features of the client (details of the cut, fabric, finishing) may be used without separate consent;
10.1.3.you may withdraw your consent to publication at any time — we will remove the relevant materials within a reasonable time.

11.Changes to this Policy

11.1.We reserve the right to make changes to this Privacy Policy. The new version is published on the Website with the date of update indicated. If the changes are material and concern an extension of the purpose of processing or new categories of data — we will notify you separately and, where necessary, obtain new consent.
11.2.Continued use of the Website or the sending of orders after the publication of changes constitutes your agreement to the updated Policy.
